Terms and conditions of sale

This contract (“Contract”) is a distance contract pursuant to art. 50 et seq. of Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”). The Contract has as its object the sale of movable property between MIA COSMETICS SRL, with registered office in Roma, Lungotevere Flaminio, P.I. 15073561001 (“MIA Cosmetics”) and the consumer (the “Customer”). The Contract is concluded directly through the acceptance by MIA Cosmetics of a purchase proposal issued by the Customer through the Internet on the website www.miamakeup.it (the “Site”) on the basis of the procedures described in Article 3 below.

 

PRICES: The sale prices of the products illustrated on the MIA Cosmetics Site are inclusive of VAT and all other taxes. Delivery costs are shown on the website and confirmed at the time of purchase depending on the services chosen.

DELIVERY AND CLAIMS: MIA Cosmetics delivers the products to the address indicated by the Customer within an average of 1-2 working days from the confirmation of the order in Italy. Delivery times may be delayed in case of holidays, carriers do not deliver on days 6/01, 15/08, 25/12, 26/12, 01/01 and weekends. More information on SHIPMENTS. AVAILABILITY OF ARTICLES: MIA Cosmetics accepts the Customer’s orders within the limits of the quantities of requested products in stock. Therefore, the acceptance by MIA Cosmetics of the purchase proposal forwarded by the Customer is subject to the availability of the products in stock. MIA Cosmetics undertakes to promptly inform the Customer of any unforeseeable depletion of stocks due to excess demand or other causes.

 

WARRANTIES: For the products purchased by the Customer, MIA Cosmetics is subject to the rules on guarantees and assistance in relation to the sale of consumer goods.

 

CUSTOMER OBLIGATIONS: The Customer declares and guarantees: to be a consumer according to art. 3 of the Consumer Code; to be of legal age; that the data provided by him for the execution of the Contract are correct and true.

 

RIGHT OF WITHDRAWAL: The customer has the right to withdraw from the contract, without penalty and without specifying the reason, within 30 days of receipt of products. The customer may exercise the right of withdrawal, within the above period, by sending a written notice, registered letter with acknowledgment of receipt to MIA COSMETICS SRL Lungotevere Flaminio Roma and sending an email to info@miamakeup.it. The customer who intends to exercise the right of withdrawal must return the products to MIA COSMETICS SRL Strada Consortile Zona ASI 81032 Carinaro (CE), within 30 days of receipt of the products. The cost of returning products are charged to the customer. MIA Cosmetics will return, within 10 days from the date of receipt of products by the customer, ALWAYS in accordance with the following conditions:

 

o The right will be applied to the product purchased in its entirety without any sign of usury and / or opening;

 

o It is possible to apply the right of withdrawal to part of the order (e.g. Article A returned, Articles C-E-F held)

 

o It is not possible to exercise withdrawal only on part of the product purchased (eg. accessories, attachments, etc …);

 

o The right does not apply to cosmetic products or sealed products once opened;

 

o The purchased goods must be intact and returned in their original packaging, complete in all its parts (including any documentation and accessories: manuals, packaging, accessories, etc …);

 

o Shipping costs are charged to the customer;

 

o The shipment, until the certificate of receipt at our depots, are under the full responsibility of the customer;

 

o In case of damage to the goods during transport, MIA Cosmetics Srl will inform the customer of the incident to allow him to file a timely complaint against the carrier of his choice; in this case, the product will be returned, with shipping costs charged by the customer, canceling the request for withdrawal;

 

o MIA Cosmetics Srl is not liable in any way for damage, theft or loss of goods returned by uninsured shipments;

 

o Upon arrival at the warehouse, the product will be examined to evaluate any damage or tampering not resulting from transport.

 

o Shipments in assigned port will not be accepted

 

COMPETENT FORUM: The Contract is regulated by Italian law. Any dispute relating to the application, execution, interpretation and violation of the Contract shall be subject to the jurisdiction of the Court of Naples.

 

FORCE MAJOR: In any case of force majeure or unforeseeable circumstances, MIA Cosmetics does not consider itself responsible for the delay or non-delivery and reserves the right to terminate the contract in whole or in part, suspend it or postpone its execution.
